Creating Pseudonymized Usage Profiles

The following remarketing pixel is used by our Technology:

If you have deactivated cookies or tracking at the domain or cookie level, this deactivation remains in place for all tracking tags implemented with Google Tag Manager.

The legal basis for data processing for this purpose lies in our legitimate interest according to Art. 6(1)(f) GDPR in optimizing and personalizing our online offer and our advertising communications.

TRANSFER OF PERSONAL DATA ABROAD

Ginesta Immobilien AG is entitled to transfer your personal data to third party companies, such as contracted service providers abroad, insofar as this is necessary for the data processing described in this data privacy policy.

These companies are required to protect your data to the same extent as we are. If the data protection level in a country does not correspond to Swiss and European standards, we contractually ensure that your personal data is protected in line with Swiss and EU requirements at all times.

For the sake of completeness in respect of users who are resident or have a seat in Switzerland, we would point out that US authorities conduct surveillance measures that generally enable the storage of all personal data of all persons whose data was transferred from Switzerland to the USA. This occurs without differentiation, limitation, or exception based on the intended aim and in the absence of an objective criterion that allows US authorities' access to the data and its later use to be limited to specific, strictly defined purposes that could justify the associated intervention to the data or to its use. Additionally, we point out that in the USA, no legal remedies are available to affected persons from Switzerland to access the data concerning them and to bring about its correction or deletion, nor is there effective judicial protection against general access rights on the part of US authorities. We explicitly inform the affected persons of these legal and factual circumstances to facilitate an informed decision in the consent to the use of their data.

For users with residence in an EU member state, we point out that the USA does not have a sufficient data protection level from the European Union's perspective – among other things due to the above-mentioned issues. To the extent that we have explained in this data privacy policy that recipients of data, such as Google, Facebook, or Twitter, have their headquarters in the USA, we will either ensure by means of contractual arrangements with these companies or by their certification under the EU-US Privacy Shield that your data is adequately protected with our partners.

Your data may be disclosed to EEA countries for processing and storage and, in exceptional cases, to any country in the world. For our part, we take care to ensure that the respective country has adequate data protection.

Should the transfer, processing, and storage of your data occur in a country without adequate data protection, this is based on contractual guarantees registered with the Federal Data Protection and Information Commissioner (FDPIC) - https://www.edoeb.admin.ch/edoeb/en/home.html. Standard contractual clauses created or recognized by the FDPIC are used, which eliminates the obligation to submit reports.

Data may also be disclosed abroad if required for the execution of a contract or to conduct legal proceedings, or if the information is already publicly available.

DATA PROCESSORS

We disclose your data to companies commissioned by us for the operation and processing of the services to the extent that is necessary. For example, our host provider or service providers such as Google with Google Analytics, which we use for online marketing as well as analytics services.

The respective service providers are bound to our data protection standards by a service contract or authorized to process personal data under standard contractual clauses recognized by the FDPIC.

DATA SECURITY

We use appropriate technical and organizational security measures to protect your personal data stored by us against manipulation, partial or complete loss, and unauthorized access by third parties.

Our security measures are continuously improved in line with technological developments. You should always treat your information confidentially and close the browser window when you have finished communicating with us, especially if you share the computer with others.

We take internal company data protection very seriously: our employees and service providers are under an obligation to maintain confidentiality and to comply with data protection regulations.

LEGAL BASES OF PROCESSING

The legal bases for the processing of personal data by us usually reside in Article 13 Paragraph 2 Letter a DPA (processing in direct connection with the conclusion or drawing up of a contract; corresponds to Article 6 Paragraph 1 Letter b GDPR) and Article 13 Paragraph 1 DPA (consent from of the party concerned or obligation to process the data by law; corresponds to Article 6 Paragraph 1 Letter a GDPR).

In those cases where we refuse to conclude contracts with affected persons going forward due to misuse, payment default, or similar legitimate reasons, we reserve the right to store the surname, first name, address, and email address of the affected person together with the data relating to the circumstances of the respective case based on Article 13 Paragraph 1 DPA (corresponds to Article 6 Paragraph 1 Letter f GDPR) to protect our own interests.

Processing of your personal data by other affiliated companies of the group can also occur based on Art. 13 Paragraph 1 DPA (corresponds to Article 6 Paragraph 1 Letter f GDPR).

YOUR RIGHTS

Within the framework of the data protection law applicable to you and to the extent therein envisaged – such as under the terms of the GDPR, for instance – you have the right to information on, correction of, deletion, and restriction of the data processed.

Upon request, we will provide any concerned party who is the subject of data with information on whether and what personal data about them is being processed under the premise of 'right to confirmation, right to information.'

Following your request, we will:

  • Partially or completely refrain from processing personal data (right to withdraw your consent to the processing of non-essential personal data, right to be forgotten). We will also inform third parties to whom we have previously disclosed your personal data of your request for deletion.
  • Correct the relevant personal data (right to correction)
  • Restrict the processing of the relevant personal data (right to restriction of processing). In this case, we will only store your personal data or use it to protect our legal entitlements or to protect the rights of another person.
  • Provide you with the relevant personal data in a structured, commonly used, and machine-readable format (right to data portability).

To submit such a request for the purposes of exercising a right described in this section, for example if you no longer wish to receive email newsletters from us or want to delete your account, please use the appropriate function on our website or contact our data protection officer or an employee as given in the contact details at the beginning of this data privacy policy.

If we do not comply with a request, we will inform you of the reasons. We may have a legally valid reason to refuse deletion if your personal data is still needed for the original purposes – for example, if you still receive a service from us, if processing is based on a mandatory legal basis, such as for legal accounting requirements, or if we have a prevailing own interest, such as in the case of a legal dispute with the affected person. If we establish a claim to a prevailing interest in processing personal data, you still have the right to object to processing, provided that your specific situation justifies a different balance of interests compared with other persons involved (right to object). This could be the case, for example, if you are a public figure or if the processing entails the risk that you may be harmed by third parties. If you are not satisfied with our response to your request, you have the right to lodge a complaint with a competent supervisory authority, such as in your country of residence or at the seat of Ginesta Immobilien AG (right to complain).

DATA RETENTION

We process personal data only as long as necessary for the designated purpose or as required by law. If you have set up an account with us, we will retain the associated master data indefinitely.

However, you can request the deletion of your account at any time (see "16. Your Rights"). We will delete the master data unless we are legally required to retain it. For a commission without an account, your master data will be deleted after the warranty period or the conclusion of the service, as long as we are not legally required to retain it. This deletion can be immediate or in the course of periodic deletion runs.

Contractual data, which may include personal data, will be retained until the end of the statutory retention period of ten years. Retention obligations arise, among other things, from accounting ordinances and tax regulations, as well as the obligation to retain electronic communications. If we no longer need this data to perform the services for you, the data will be blocked. This means the data may only continue to be used for accounting and tax purposes.

Should we refuse further business relations with an affected person due to misuse, payment defaults, or other legitimate reasons, we retain the relevant personal data for five years, or ten years in the event of recurrence.

POSSIBILITY TO OPT-OUT / OPT-IN

If you do not agree to have your usage data analyzed by us, you can turn it off.

The tracking is turned off by placing a so-called "opt-out cookie" on your system. If you delete all your cookies at some point, please note that the opt-out cookie will be lost and may need to be renewed.
